The commerce.gov website now shows that most agency leadership positions are filled, leaving only a handful of vacancies under the new administration. One of those vacancies is for USPTO Director. There have been conflicting reports as to whether Michelle Lee will continue in that position. IP Watchdog reported, earlier this month, that Lee has no intention of leaving the USPTO voluntarily. Some, including well-known IP attorney Hal Wegner, have called on her to resign.
The consensus at this point seems to be that Lee is out, though that's far from a unanimous view (just two days ago, the Business Software Alliance sent out a press release commending the Trump administration for keeping Lee). Whatever the final outcome, the patent system is best served by a speedy resolution to this issue. We need to know who is in charge at the USPTO.
